Commercial Licensing Terms

About these terms

These terms apply to commercial licences granted by Loom Illustrations, run by Abbey Welch, a UK sole trader.

Email: loomillustrations@gmail.com

Your written licence confirmation identifies the artwork, the person or business receiving the licence, the permitted uses, fee and any applicable limits. Any specific variations we expressly agree in writing take priority over these terms.

Where you are commissioning a new painting, the Commission Terms also apply to its creation and delivery.

Agreeing your licence

Before you commit, we will agree the intended use and any relevant products, quantities, territories, duration or exclusivity.

Your agreement is confirmed when you accept the licence details and these terms in writing, and I reply confirming acceptance. Permission to use the artwork begins once the agreed licence fee and any outstanding commission balance have been paid in full, unless we agree otherwise in writing.

Only the uses expressly included in your licence are permitted. Additional uses require my written agreement and may involve an additional fee.

Book Licences

Unless your licence confirmation states otherwise, a Book Licence permits use of the artwork inside or on the cover of one named book, including its print, ebook and audiobook editions, and in advertising and promotion of that book.

The licence is worldwide, lasts for the duration of copyright in the artwork and has no copy limit or renewal fee. It does not include use for another book, separately sold art prints, merchandise or other products. These uses require separate permission.

Other commercial licences

Licences for art prints, packaging, merchandise and other commercial uses cover only the products and uses recorded in your licence confirmation.

Any quantity limit, territory or expiry date will be stated before you agree. Please contact me before exceeding those limits or adding new products.

Copyright and exclusivity

I retain copyright in my original artistic contribution to the artwork. A licence grants permission to use the artwork; it does not transfer copyright. Rights in any pre-existing material remain with their existing owner.

Licences are non-exclusive unless we expressly agree otherwise in writing. This means I may continue to share the artwork, sell art prints and license my contribution to others, subject to any underlying rights and restrictions we have agreed.

Any exclusivity must be set out in a separate written agreement, including its scope, duration and any uses I retain.

Preparing and sharing files

You may provide files to printers, publishers, designers and other suppliers solely to carry out the licensed use on your behalf. They receive no independent right to use or sell the artwork.

You may not otherwise transfer or sublicense your licence, sell or distribute the artwork as a standalone digital file, or make the high-resolution file publicly available.

Please credit Loom Illustrations wherever reasonably practical. For a book, please include the credit on its copyright or acknowledgements page.

Cancellation and problems

If the artwork incorporates material you supply, you confirm that you own or have the permissions needed for its creation and the commercial uses you request.

If you use the artwork outside the agreed licence, I may require you to stop that use. For a serious breach, or a breach you do not remedy within a reasonable period after written notice, I may terminate the licence. Any notice will explain what this means for existing stock and promotional materials.
